MyChart SGMC Terms and Conditions of Use Agreement

MyChart SGMC (“MyChart”) provides you with online access to portions of your electronic medical record, as well as other functionalities accessed through MyChart (the “Service”).  

This MyChart SGMC Terms and Conditions of Use Agreement (the “Agreement”) is a legal document. By clicking “I Agree” below or otherwise using the Service, you are: (1) acknowledging that you have read and understand this Agreement; and (2) agreeing to be bound by this Agreement.  If you do not agree to be bound by this Agreement, click “I Do Not Agree” and you are not permitted to use the Service.

This Agreement is between you and the Hospital Authority of Valdosta and Lowndes County, Georgia.  “We” and “us” and “the Hospital Authority” means the Hospital Authority of Valdosta and Lowndes County, Georgia. “You” means the person who clicks “I Agree” below or otherwise uses the Service.  However, if you are clicking “I Agree” below or are otherwise using the Service on behalf of another person as their legally authorized representative and the person being represented the Service must be used only for the benefit of the person represented.

The Service may include functionality that allows you to: (1) view parts of your medical records; (2) communicate with Hospital Authority facilities and/or individual health care providers; (3) request appointments; (4) access other MyChart and/or Happy Together accounts you may have with other health care providers; and (5) other services as offered by the Hospital Authority at the Hospital Authority’s discretion.  Some functionalities have their own set of rules and terms and conditions in addition to this Agreement.  When using the Service, you are bound by the terms of this Agreement as well as the terms and conditions for any specific functionality that you utilize within the Service that are incorporated herein by reference.  To the extent that there are any inconsistencies between the terms of this Agreement and the applicable set of terms and conditions for a specific functionality, the terms and conditions for the specific functionality shall control.  It is important to review this Agreement and all of the above referenced terms and conditions periodically as we may modify them at any time in our sole discretion. 

URGENT MEDICAL MATTERS:  The medical or health care information provided on MyChart is not a replacement for proper medical attention. Contact your physician, go to an Emergency Room or call 911 immediately if you are suffering from urgent medical issues.

Medical Information:  Information on MyChart is provided "as is" without warranty of any kind.  You understand that not all of your medical record may appear as part of the Service.  Posting of your medical information to the Service, in whole or in part, is pursuant to our policy and at the discretion of your physician.

Information provided on this site does not constitute medical advice. Relying on the material in MyChart is at your own risk. You should consult with a physician or other healthcare provider regarding your own condition and how this site content may or may not apply to you. You may be accessing your own medical information via MyChart and may wish to communicate with one of your healthcare providers about that or related information. Neither MyChart nor any other application available through this site is a substitute for appropriate and timely contact or consultation with your physician. You should never change or stop any course of treatment prescribed by your physician without first consulting him or her.

MyChart User Responsibilities 

By using MyChart, you agree to all the terms and conditions of this Terms and Conditions Agreement (“Agreement”) and our posted Notice of Privacy Practices, found at We may modify this Agreement and the Notice of Privacy Practices at any time, and you agree to those changes as soon as they are posted. You should review this Agreement and the Notice of Privacy Practices from time to time so that you are aware of all changes. 

You understand that the Hospital Authority cannot guarantee the accuracy or correctness of the site. There may be typographical errors or other mistakes. You agree to complete an amendment request form if you find errors in your medical or health care information. 

The Hospital Authority assumes no responsibility for how you use the information you obtain from MyChart.  When you download or view information on MyChart, you agree to hold the Hospital Authority, its officers, employees and agents harmless and will not hold them liable for any damages or claims arising out of, or in any way connected with, your use of MyChart or the information contained on this site. 

MyChart may offer links to other healthcare Web sites not managed by the Hospital Authority. These sites are informational only; the Hospital Authority does not endorse and has not verified the accuracy of the information in/on these sites, and you should not rely on any of the information on these Web sites for medical diagnoses or treatment. You should never change or stop any course of treatment prescribed by your physician without consulting him/her.

MyChart is a registered trademark of EPIC Systems Corporation (“EPIC”). MyChart information and logos, icons and other marks are reserved by EPIC and the Hospital Authority and are protected by copyright and trademark law. You agree that you will not reproduce any information without written consent of EPIC and the Hospital Authority. 

You understand and agree that you are solely responsible for any sharing of MyChart information that you intentionally or unintentionally communicate to others, and that the Hospital Authority shall not be liable for any damages suffered by you or third parties related to the material and information in MyChart.

Any communications between you and healthcare providers using MyChart occur over a secure connection. You are required to provide a valid e-mail address, and it is your responsibility to keep this address updated with MyChart if you change your e-mail account. 

You understand that the Hospital Authority takes no responsibility for, and disclaims any and all liability or damages arising from a breach of medical record confidentiality resulting from your sharing or losing your password. If the Hospital Authority discovers that you have inappropriately shared your password with another person, or that you have misused or abused MyChart access privileges in any way, your participation in MyChart may be discontinued without prior notice.

You agree that you will not post any offensive material on this site. If we determine that you have violated this Agreement or abused the use of this Service, we reserve the right, at our sole discretion, to terminate your use and access of MyChart. You will be notified if your MyChart service has been discontinued. 

Response to Electronic Communication:  We attempt to provide a timely response to electronic inquiries. In some cases, staff that needs to respond to an electronic inquiry or other communication may not be immediately available, so patients should allow at least three (3) business days for a response. Accordingly, emergency situations requiring immediate attention should not be submitted electronically. Contact your physician, go to an Emergency Room or call 911 immediately if you are suffering from urgent medical issues.  The Hospital Authority is only able to respond to electronic communications sent by the patient based on the information provided by the patient. If there is insufficient information provided, the Hospital Authority will be unable to provide accurate and reliable responses.

Availability of MyChart:  MyChart may not always be available to you due to system maintenance, back-ups or failures. Access is provided on an "as is available" basis, and you are not guaranteed access at any particular time.  During times when the Service is unavailable, you are encouraged to use other traditional communication methods to retrieve necessary medical information.

Login Name and Password:  The access code you receive will give you the opportunity to create a personal login name (called MyChart ID) and a password. Once this access code has been used, it will no longer be valid. It is extremely important that you keep your login name and password completely confidential. YOU MUST NOT SHARE YOUR USERNAME AND PASSWORD WITH ANYONE.  YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF YOUR USERNAME AND PASSWORD AND FOR ALL ACTIVITIES THAT OCCUR UNDER YOUR USERNAME AND PASSWORD, WHETHER OR NOT AUTHORIZED BY YOU.  Anyone with access to your login name and password will be able to access your confidential medical information. That person will also be able to read your messages and send new messages as if that person were you. It is your responsibility to keep your login and password confidential, and to change your password if you feel that its security has been compromised. You may change your password at any time.

Proxy Access:  Individuals may request proxy access to a minor’s MyChart account by completing and submitting the Proxy Access portion of the MyChart Consent Form.  Such access will be granted to parties with parental rights or legal guardianship over the patient and only to the extent that the party requesting proxy access has the right to access the patient’s medical information. If the proxy’s legal relationship with the patient changes, the proxy must inform the Hospital Authority immediately.  We reserve the right to revoke proxy access at any time for any reason.

Legal Representatives:  You understand that if you have appointed a legal representative, such representative will be able to access your account and all the information in the account.  In addition, such representative may take action on your behalf via the Service.  It is your responsibility to choose an appropriate authorized representative and we are not responsible for actions taken by your representative.  If you no longer wish for an authorized representative to have access to your account, you are responsible for revoking such access.

Loss of Access to MyChart:  Your access to MyChart may be restricted or terminated at any time. Each circumstance will be evaluated and decided individually. The following list includes, but is not limited to, reasons which will result in loss of access: 

1. You are not following specific terms and conditions for use of the Service.

2. You are no longer a patient of a hospital, practice or health care facility owned by the Hospital Authority.

3. You have had a number of failed login attempts to access MyChart, or you are unable to use MyChart features without constant assistance.

4. You have accessed other patients’ MyChart accounts without their consent.

5. You have engaged in improper activities on MyChart, including but not limited to, excessive/unnecessary/inappropriate use of messaging or scheduling.

6. You have pending legal issues with the Hospital Authority or your provider. 

E-mail:  You will be notified via e-mail when there is new medical information to be viewed on your MyChart account. This means that any person with access to your e-mail will be able to see this notification. This could include your spouse, employer or anyone else that can access your e-mail account. Although no private medical information will be sent in this e-mail, this notification that new medical information is available by accessing MyChart may be information that you would not want others to know. You should take this into account when providing an e-mail address. 

Use of Third Party Services:  You may choose to use other services provided by third parties in conjunction with your use of the Service.  Such third party services may include, but are not limited to, translation services, location services, and other third party offerings.  Any links to such third party services are provided for your convenience only.  Neither EPIC nor the Hospital Authority accept any responsibility for the contents of these third party services, and neither EPIC nor the Hospital Authority accept any responsibility for them or for any loss or damages that may arise from your use of them.  Such third party services may require you to submit information to a third party, which may result in a copy of your information being used and/or stored by a third party.  If you decide to access any such third party services in conjunction with your use of MyChart, you do so entirely at your own risk and subject to the terms and conditions of use for such third party services.

Security and Confidentiality

The confidential medical information available to you in MyChart is protected and securely maintained. The Hospital Authority utilizes industry accepted methods and technical security measures to protect the confidentiality and integrity of your information.  However, no system can perfectly guard against risk of intentional intrusion or inadvertent disclosure of information. 

Access and activity of your MyChart information is recorded. The Hospital Authority may collect information you provide about yourself through the forms offered on our site. This is to provide personalized services, or communicating separately with you. This personal information is not shared with any third party outside of the Hospital Authority.

The Hospital Authority may also collect information about your visit to our MyChart web site such as the date and time of your visit, the pages of our site you visited, and your IP address of origin. We may use this information to help us understand the effectiveness of our web site and how we can improve it.

You understand that the Service provides you with online access to portions of your electronic medical record and that you are solely responsible for any disclosure of the Service content that you communicate to others, including through your legal representatives.  

MyChart is configured to be secure from unauthorized access, but the Hospital Authority cannot be held responsible for: a) absolute security of all electronic communication transmissions; b) unauthorized disclosure resulting from a user not logging out of an active session; c) unauthorized disclosure resulting from a lost or stolen user ID and password; d) unauthorized disclosure resulting from information printed by the user from MyChart; e) unauthorized disclosure resulting from personal computer settings or installed software products that may compromise information security; or f) similar events outside the control of the Hospital Authority.

Copy of Complete Medical Record:  The electronic record in MyChart is the property of the Hospital Authority and the information displayed in MyChart is only a portion of your complete medical record.  Contact the hospital medical records department or your physician’s office directly for a copy of your medical record.


Governing Law:  This Agreement shall be governed by the laws of the State of Georgia.

Entire Agreement:  This Agreement contains the entire agreement between the parties with respect to the subject matter contained herein. The terms of this Agreement may be changed at any time in the discretion of the Hospital Authority and updated terms will be posted on the MyChart website for user access.

Other Uses of MyChart Information:  I understand that from time to time I may be asked to complete patient satisfaction surveys via MyChart. The Hospital Authority may analyze information submitted via MyChart as part of descriptive (demographic) studies and reports. In such cases all of my personal identifying information will be removed.

Fees:  The Hospital Authority reserves the right in the future to charge a fee for the use of MyChart. You will be notified of this change, should it occur, and asked to re-apply if you agree to the fee and wish to continue using MyChart.


By agreeing to these terms and conditions, I authorize the Hospital Authority to release my personal health information to me via MyChart. 

By clicking “I Agree” or otherwise using the Service, you represent and warrant to the Hospital Authority that you possess the legal right and ability to enter into this Agreement and to use the Service and agree to be financially responsible for your use of the Service.  By clicking “I Agree” or otherwise using the Service, you acknowledge that any previous consents given by you to the Hospital Authority will apply.
